Crypto tax basics in Poland

General information for Polish tax residents, not tax advice. Rules change, so check with the tax office or an adviser before you file.

PIT-38 and the 19% rate

Income from selling crypto is reported in the PIT-38 return and taxed at a flat 19% (art. 30b of the Personal Income Tax Act). The return covers the tax year and is filed by the end of April of the following year.

When income arises

Income arises when you convert crypto into fiat currency or pay for goods or services with it. Swapping one crypto for another is not taxed on its own.

Costs: no FIFO or LIFO

Acquisition costs are counted in the tax year in which they were incurred, not matched to specific coins with FIFO or LIFO. Ask the tax office how to treat costs that exceed your income.

Documents to keep

Exchange statements with dates, amounts and prices, proof of PLN deposits and withdrawals, and wallet transfer records. For amounts in foreign currency you need the average NBP rate from the day before the transaction.
